Does my Project Need a Performance Guarantee or a Permit, or Both?
- As of April 1, 2020, a C&D Permit and a Performance Guarantee are required for building & demolition projects >5,000 ft2
- As of January 1, 2021, a C&D
Permit and a Performance Guarantee are required for building
and demolition projects >5,000 ft2 and those projects
between 1,000 and ≤ 5,000 ft2 that do not use an Approved
Collector.
- Projects between 1,000 and ≤ 5,000 ft2 that use an Approved Collector are eligible to use the Approved Collector Compliance Method where NO performance guarantee is required.
- Major Grading projects (>5,000 cu. yds.) do NOT require a Performance Guarantee but DO require a Debris Management Plan (DMP) & must comply with recycling requirements through the Major Grading Permit process.

What is a Performance Guarantee?
A Performance Guarantee is a refundable deposit to ensure compliance with the C&D recycling requirements. Full compliance with recycling requirements will result in a full refund. A pro-rated refund will be granted for partial compliance.
The C&D Performance Guarantee is calculated based on the square footage of the building or demolition project. The rate is $0.40 per square foot, with a project cap of $40,000. Deposits are cash only (check, money order, etc.).
On Phased Projects, Do I Have to Submit More Than One DMP and Additional Performance Guarantees?
A new DMP and Performance Guarantee should be submitted for each phase which requires its own permit for a residential tract or multi-building commercial projects.
