The Trafficking and Crime Victims Assistance Program (TCVAP) provides critical support, benefits, and services to victims of human trafficking who are not eligible for federally funded benefits and services due to immigration status or those victims awaiting federal benefits.

Counties are required to provide a state-only program to assist trafficking victims prior to federal certification by the Office of Refugee Resettlement (ORR). The Trafficking and Crime Victims Program (TCVAP) allows certain non-citizen victims of human trafficking and domestic violence or other serious crimes to receive state funded benefits while their T or U Visas are being processed by ORR.

T-VISA GROUP INFORMATION

Victims of trafficking can become federally eligible; regardless of being a single adult or a family. Once the T Visa is approved, the individual needs to be evaluated for a Federally funded aid code from the date of the ORR Certification and is considered the same as a Refugee. The Non-Citizen status would then need to be changed effective the date of the ORR Certification to ensure the correct aid codes are set on the case.

 

U-VISA GROUP INFORMATION

Victims of domestic abuse and/or crime will always remain state eligible and can never become federally eligible. This is regardless of being a single adult or a family.
