Background Information and Purpose of Public Disclosure

The Rams Hill Specific Plan is located within the southeast portion of the Borrego Springs Community Planning Area, bordered by the Yaqui Pass Road to the west and Anza-Borrego Desert State Park to the south, with Borrego Springs Road bisecting the north and east portions of the plan area. The applicant for the submitted Development Agreement Threshold Decision (Record ID: PDS2019-DA-19-001) proposes to reconfigure the existing plan area and is requesting a Development Agreement in order to establish and maintain vested rights over a minimum term of 30 years. Development agreements are intended to provide certainty to a developer proposing a long-term development project, to protect against changes in local law during the life of the project while at the same time having the developer provide public benefits in exchange for the certainty granted to the developer. The County code requires a “Threshold Procedure” for a development agreement associated with a previously approved project, which provides a preliminary analysis, but not a formal land use decision. The Preliminary Report is required to be submitted to the Borrego Springs Community Sponsor Group and any affected public agency for a 30-day public review period. The proposed Preliminary Report will be presented to the Planning Commission, and then to the Board of Supervisors for decision. The Board will decide whether to authorize the applicant to file an application for a development agreement for the proposal, or direct staff to terminate proceedings. Any comments on the Preliminary Report will be accepted from November 21, 2019 to December 23, 2019.
