Aspects of Property Redevelopment Guidance

A guideline has been prepared to facilitate site investigation and
remediation actions in a streamlined fashion. This guideline was
developed through the SAM Technical Workgroup to assist interested
parties in redeveloping these types of sites.
The focus
of this guidance on property redevelopment is to describe the
redevelopment process and to explain the services offered by the
Department of Environmental Health and Quality (DEHQ).
Brownfields
The term 'Brownfield site' refers to real property including the expansion, redevelopment, or reuse of property which may be complicated by the presence or potential presence of a hazardous substance, pollutant, or contaminant.

Exclusions from Brownfields:
- a facility that is the subject of a planned or ongoing removal action.
- a facility that is listed on the National Priorities List or is proposed for listing.
- a facility that is the subject of a unilateral administrative order, a court order, an administrative order on consent or judicial consent decree
- a facility to which a permit has been issued under the Solid Waste Disposal Act, the Federal Water Pollution Control Act, the Toxic Substance Control act or the Safe Drinking Water Act.
- a facility that is subject to corrective action under the Solid Waste Disposal Act and to which a corrective action permit or order has been issued.
Site Designation Process
The DEHQ has three programs available to provide regulatory oversight of the investigation and cleanup of chemically contaminated soil and groundwater at Brownfields sites in the County of San Diego. These programs are the Local Oversight Program, Voluntary Assistance Program and Site Designation Program. The Site Designation Program is available through the CAL-EPA Site Designation Committee appointing the DEHQ as the administering agency to oversee the site investigation.
